Do you handle entity and authority review?

Yes — company agreements, certificates of formation, resolutions, partnership agreements and trust instruments. Establishing who can bind the entity is where commercial closings most often stall, so we start it early.

What about surveys and easements?

A commercial survey routinely turns up encroachments, access questions and easements that affect what can be insured and what a lender will accept. We coordinate between the surveyor, counsel and the lender on the exceptions and endorsements.

Can you handle leases and tenant estoppels?

We coordinate the title and closing side around them. Existing leases affect the title commitment's exceptions, and the estoppels themselves are typically driven by counsel and the parties.

Are commercial title premiums also promulgated?

The basic premium follows the same Texas Department of Insurance rate table, so it does not vary by company. Endorsements, survey work and escrow fees are where commercial files actually differ in cost.
