Jamie Ellis' payoff and release source packet

Send the payoff statement, servicer and release trail before a lien question slows funding.

For agents and lenders: collect the deed of trust, assignment chain, payoff request, servicer response, release clue, county recording reference, commitment item and one process question before a payoff or lien-release issue becomes urgent.

Audience and job

Make a payoff or release question easier to route.

A payoff question can pull in a deed of trust, assignment chain, servicer transfer, payoff statement, per diem, corrected payoff, release, county-record reference, lender condition, title-commitment item, underwriter review and attorney advice. This handoff keeps the source trail together without deciding the file-specific result.

The useful handoff

Name the county, lender or servicer, request date, proposed closing date, good-through date, payoff or per diem clue, assignment or release recording reference, title-commitment item and source date. The recorded documents, servicer response, lender review, title commitment and underwriting response still control the answer.

Official sources

Use current statute, servicing, county-record and TDI sources.

These sources were checked on October 7, 2026. They help frame the payoff and release packet, but they do not replace mortgage servicer, lender, title, underwriting, attorney, recording or legal review.

Texas Finance Code Chapter 343, read October 7, 2026

Start with the title-company payoff-statement source.

Section 343.106 is the current Texas source for title-insurance-company payoff-statement requests on home loans. A useful handoff preserves the proposed closing date, requested good-through date, servicer response, payoff amount, correction clue and title-commitment item without deciding payoff sufficiency.

7 Texas Administrative Code Section 155.2 and 155.3, read October 7, 2026

Separate the payoff form from the closing answer.

The Texas mortgage-servicer rule describes written payoff requests, required payoff-statement information, optional per diem and release-of-lien fields, and the eighth-business-day delivery rule unless federal law requires a shorter response time. Preserve dates and source trail; do not calculate or guarantee the final payoff.

Texas Property Code Chapter 12, read October 7, 2026

Keep release-of-lien evidence tied to the recorded mortgage trail.

Section 12.017 addresses a title-insurance-company affidavit as release of lien in defined circumstances. A source packet should preserve the deed of trust, assignment chain, payoff statement, payment clue, notice clue and release or affidavit recording reference without deciding whether a release is effective.

Texas Department of Savings and Mortgage Lending, read October 7, 2026

Use the regulator's mortgage-servicing page for servicer context.

The Department states that residential mortgage loan servicers for loans secured by Texas residential real estate must be registered with the Department and provides mortgage-servicing forms, including a payoff statement form. Send the servicer name, transfer clue, account clue and request channel found, not private credentials.

Collin County Land Recordings, read October 7, 2026

Anchor the payoff question to county-record references.

Collin County's land-recording page warns that online database results are not the official repository and may not show the complete or unaltered official record. Send instrument numbers, recording dates, assignments, releases, legal-description clues and title-commitment item numbers instead of relying on search memory.

TDI Procedural Rule P-53, read October 7, 2026

Keep the handoff public, educational and referral-safe.

TDI P-53 permits legal promotional and educational activity that is not conditioned on referral of title-insurance business. This handoff offers public source organization only; it does not discount a title premium or provide a referral benefit.

What to send

Give each reviewer the payoff trail they can verify.

A deed-of-trust payoff and release handoff does not need to decide lien priority, release effect, payoff sufficiency, assignment effect, shortfall responsibility, insurability or legal effect. It needs enough source context for the right professional to identify the next step.

  1. Property address, county, transaction type, proposed closing date, payoff good-through date and whether the concern involves an original deed of trust, assignment, servicer transfer, payoff statement, per diem, release, title-commitment requirement or lender condition
  2. Lender or servicer name, loan or account clue already safe to share, request channel, request date, response date, proposed closing date, payoff statement date, amount-valid-through date and any corrected-statement clue
  3. Recorded deed of trust, assignment, modification, release, affidavit as release of lien, county recording reference, title-commitment Schedule B or C item number and lender or underwriter request that triggered the question
  4. Exact borrower or owner names, mortgagee or assignee names, document numbers, recording dates, county-record references, legal-description clue, payoff shortfall clue and the person responsible for follow-up
  5. One practical process question for the title team, lender, mortgage servicer, attorney, underwriter or county-record source before the file reaches funding or signing pressure
What to avoid

Keep lien effect and payoff conclusions out of the first note.

  • Do not decide whether a payoff statement, release, assignment, deed of trust, affidavit, notice or servicer response is valid, sufficient, enforceable or legally effective.
  • Do not decide payoff sufficiency, lien priority, lien attachment, release effect, assignment effect, per diem accuracy, shortfall responsibility, title effect or recording effect.
  • Do not draft release, affidavit, demand, payoff, assignment, closing-instruction, dispute, settlement or legal-remedy language.
  • Do not promise lender approval, funding, title coverage, underwriting acceptance, county-record acceptance, recording, insurability or a closing date.
