Jamie Ellis' guardianship authority source packet

Send the order, letters and court clues before authority questions slow the file.

For agents, lenders and attorneys: organize the guardianship court, cause number, letters, guardian, lender and title-commitment clues so the right reviewer can answer the right question.

Audience and job

Make a guardianship file easier to route.

Guardianship-related closings can mix court orders, letters, guardian authority, lender conditions, title requirements, annual-report clues and attorney review. This handoff keeps the sources separated before the file turns into a signing-day search for the right guardianship or underwriting reviewer.

The useful handoff

Name the court, cause number, guardian, order, letters, qualification date, lender condition and title-commitment question you have. The court file, attorney advice, lender, title commitment and underwriting review still control the file-specific result.

Official sources

Use current court, JBCC, Estates Code and TDI sources.

These sources were checked on September 25, 2026. They help frame the guardianship-authority packet, but they do not replace court, guardianship-attorney, lender, title, underwriting or legal review.

Collin County Probate Court guardianship page, read September 25, 2026

Start with the local court source.

Collin County Probate Court explains that guardianship is a court process and directs guardians and applicants to JBCC registration, training, annual-report and local probate-clerk resources. Send the court, cause number, order and letters you have instead of summarizing authority yourself.

Texas JBCC guardianship registration resources, updated June 24, 2026; read September 25, 2026

Keep registration and training clues with the court file.

The Judicial Branch Certification Commission maintains guardianship registration rules, public resources, training materials and updated filing information sheets. Use it to identify registration context, not to decide whether a guardian may sign closing documents.

Texas Estates Code Chapter 1106, read September 25, 2026

Send the letters and appointment order together.

Chapter 1106 is the official source for letters of guardianship. The order, letters, qualification date, bond, court file, attorney guidance, lender review and title underwriting still decide what a transaction team can rely on.

Texas Estates Code Chapter 1151, read September 25, 2026

Use the duties-and-powers source without making the legal call.

Chapter 1151 is a source for guardian duties, rights and powers. It can help label the issue for counsel or underwriting, but it does not turn a real-estate handoff into a legal opinion about authority, capacity or property rights.

JBCC guardianship FAQ, read September 25, 2026

Add the qualification, case and training facts when known.

The JBCC FAQ addresses registration, qualification date, co-guardians, training, background-check and court-notification questions. Those clues can help a title team know which reviewer needs the documents, without deciding if the documents are sufficient.

TDI Procedural Rule P-53, read September 25, 2026

Keep this public, neutral and referral-safe.

TDI P-53 permits legal promotional and educational activity that is not conditioned on referral of title-insurance business. This handoff offers source organization only; it does not discount a title premium or provide a referral benefit.

What to send

Give each reviewer the guardianship source they can verify.

A guardianship-authority handoff does not need to decide authority, capacity, order scope, title coverage, lender approval or underwriting acceptance. It needs enough source context for the right professional to identify the next step.

  1. Property address, county, contract status, target closing date and whether the file involves a sale, refinance, guardian of the person, guardian of the estate, co-guardian, successor guardian, temporary guardian, ward, minor, incapacitated adult, lender condition or title-commitment requirement
  2. Court, county, cause number, judge, order appointing guardian, letters of guardianship, qualification date, bond clue, annual-report clue, JBCC registration or training clue, successor or co-guardian clue and any attorney contact already available
  3. Names of the ward, guardian, co-guardian, successor guardian, applicant, seller, buyer, lender, guardianship attorney, ad litem, title-company contact, underwriter contact or court-record source whose review may be needed
  4. Instrument number, title-commitment item number, court order exhibit, legal description, deed clue, payoff clue, lender-condition clue, public-source URL and any deadline or hearing date already found
  5. One process question for the title team, lender, guardianship attorney, court source, underwriter or payoff contact before the file reaches funding or signing pressure
What to avoid

Keep guardianship and title conclusions out of the first note.

  • Do not decide whether the guardian, co-guardian, successor guardian, temporary guardian, applicant, attorney, ward or court order gives someone authority to sell, refinance, sign, convey or bind a transaction.
  • Do not decide capacity, guardianship validity, order scope, letters sufficiency, bond sufficiency, annual-report status, JBCC compliance, homestead effect, ward rights, deed sufficiency or payoff sufficiency.
  • Do not draft guardianship pleadings, court orders, applications, letters, deeds, releases, title objections, lender conditions, payoff instructions or attorney legal cures.
  • Do not promise lender approval, funding, title coverage, underwriting acceptance, court timing, recording acceptance or a closing date.
