Jamie Ellis' judgment-lien source packet

Send the abstract, release and payoff clues before the file becomes a lien-status debate.

For agents, lenders, sellers, buyers, investors and attorneys: organize the judgment, abstract, recording, payoff, release, court and commitment clues so the right reviewer can answer the right question.

Audience and job

Make a judgment or abstract issue easier to route.

A judgment-lien file can raise several questions at once: what the abstract says, whether something was recorded, whether a payoff or release exists, what the lender requires, what the title commitment requests and whether counsel needs to answer a legal question. This handoff keeps those sources separated before the file turns into a closing-day status argument.

The useful handoff

Name the judgment, abstract, release, payoff, court, county or title-commitment source you have and ask one process question. The court record, real-property record, lender instruction, title commitment, attorney advice and underwriting review still control the file-specific result.

Official sources

Use current judgment, land-record and TDI sources.

These sources were checked on September 22, 2026. They help frame the judgment-lien packet, but they do not replace court, deed, lender, title, underwriting or legal review.

Texas Property Code Chapter 52, read September 22, 2026

Separate the abstract from the lien conclusion.

Chapter 52 is the Texas source for judgment liens, abstracts of judgment, recording and indexing, satisfaction of judgment and duration language. Send the abstract, recording reference, judgment source and title-commitment item instead of deciding whether a lien attaches, continues or has been released.

Texas Civil Practice and Remedies Code Chapter 31, read September 22, 2026

Keep Satisfaction of judgment clues tied to the court source.

Chapter 31 includes judgment and court-payment provisions, including a release path when a judgment creditor cannot be located. If the file mentions a paid judgment, registry payment or court release, send the actual court, cause number, amount clue and document reference for review.

Treat online record hits as source references.

Collin County's land-recording page warns that its online database is not the official repository and may not show the complete or unaltered official record. Send instrument numbers, recording dates, party names, county and source link without treating an online hit as the full title answer.

What to send

Give each reviewer the judgment fact they can verify.

A judgment-lien handoff does not need to decide attachment, priority, dormancy, release sufficiency, homestead effect, lender approval or underwriting acceptance. It needs enough source context for the right professional to identify the next step.

  1. Property address, county, contract status, target closing date and whether the file involves a sale, refinance, judgment, abstract, release, satisfaction, payoff, homestead question, lender condition or title-commitment requirement
  2. Abstract of judgment, certified judgment, release, satisfaction, payoff statement, court registry clue, returned execution, title commitment, prior title policy or deed record already available
  3. Names of the judgment debtor, judgment creditor, record owner, seller, buyer, lender, payoff contact, attorney, court, cause number and any party whose status is unclear
  4. Instrument numbers, recording dates, book/page or document references, county, court, title-commitment item numbers and payoff or release document references already found
  5. One process question for the title team, lender, attorney, court-record source, payoff source, underwriter or county-record source before the file reaches funding or signing pressure
What to avoid

Keep legal conclusions out of the first note.

  • Do not decide lien validity, priority, attachment, duration, dormancy, revival, homestead effect, exemption status or whether an abstract has legal effect.
  • Do not decide whether a payoff, satisfaction, returned execution, court registry payment or release is sufficient for a title-commitment requirement.
  • Do not draft releases, affidavits, court motions, payoff demands, legal objections, settlement terms, title objections or attorney legal cures.
  • Do not promise lender approval, funding, title coverage, underwriting acceptance, curative timing, recording acceptance or a closing date.
