Jamie Ellis' power-of-attorney source packet

Send the POA, agent and signing clues before the file becomes an authority debate.

For agents, lenders and attorneys: organize durable power of attorney, principal, agent, deed, lender and title-commitment clues so the right reviewer can answer the right question.

Audience and job

Make a POA signing file easier to route.

Power-of-attorney questions can mix a principal, agent, successor agent, deed history, recording reference, lender condition, title requirement, home-equity clue and attorney review. This handoff keeps the sources separated before the file turns into a closing-week debate about capacity or authority.

The useful handoff

Name the county, deed, POA type, principal, agent, signing role, recording reference, lender condition and title-commitment question you have. The instrument, lender, title commitment, attorney advice, county record and underwriting review still control the file-specific result.

Official sources

Use current durable-POA, statutory-form and county-record sources.

These sources were checked on September 30, 2026. They help frame the signing packet, but they do not replace deed, lender, title, underwriting, attorney, capacity, recording or legal review.

Texas Estates Code Chapter 751, read September 30, 2026

Separate the POA document from the authority conclusion.

Chapter 751 is the Texas source for general durable-power-of-attorney provisions, including acceptance and refusal concepts. Send the signed POA, principal, agent, successor-agent, effective-date, revocation, divorce, incapacity, lender and title-commitment clues; do not decide whether the agent can sign.

Texas Estates Code Chapter 752, read September 30, 2026

Flag the statutory form and real-property powers without interpreting them.

Chapter 752 contains the Texas statutory durable power of attorney form and the real-property transaction power language. Send the initialed powers, special instructions, notary clue, agent certification, home-equity clue and transaction documents to the reviewer instead of summarizing legal authority.

Collin County Land Recordings, read September 30, 2026

Tie the signing question to the recorded-instrument trail.

Collin County's land-recording page warns that online database results are not the official repository and may not show the complete or unaltered official record. Send recording references, document dates, parties, legal description and source links without treating a search hit as the complete title answer.

Keep the handoff educational and referral-safe.

TDI P-53 permits legal promotional and educational activity that is not conditioned on referral of title-insurance business. This handoff offers public source organization only; it does not discount a title premium or provide a referral benefit.

What to send

Give each reviewer the POA source they can verify.

A power-of-attorney handoff does not need to decide authority, validity, capacity, recordability, title coverage, lender approval or underwriting acceptance. It needs enough source context for the right professional to identify the next step.

  1. Property address, county, contract status, target closing date and whether the file involves a durable power of attorney, statutory durable power of attorney, agent certification, successor agent, home-equity clue, lender condition or title-commitment requirement
  2. Principal name, agent name, successor-agent name, signing capacity, POA date, notary clue, initialed powers, special instructions, revocation clue, divorce clue, incapacity clue and any attorney, lender or underwriter request already received
  3. Current deed holder, proposed seller, buyer, attorney, lender, title-contact person, payoff contact and any person whose capacity, signature role, identity or authority is unclear
  4. Instrument numbers, recording dates, book/page or document references, county, legal description, title-commitment item number, lender-condition clue and public-source URL already found
  5. One practical process question for the title team, lender, attorney, underwriter or county-record source before the file reaches funding or signing pressure
What to avoid

Keep POA authority and title conclusions out of the first note.

  • Do not decide whether a power of attorney is valid, durable, effective, revoked, terminated, rejected, recordable or sufficient for this property or loan.
  • Do not decide principal capacity, agent authority, successor-agent authority, fiduciary compliance, divorce effect, incapacity effect, home-equity signing sufficiency or whether a principal may delegate a specific signing act.
  • Do not draft powers of attorney, certifications, affidavits, revocations, deeds, title objections, lender responses, attorney instructions, curative instruments or legal remedies.
  • Do not promise lender approval, funding, title coverage, underwriting acceptance, county-record acceptance, recording, insurability or a closing date.
