Jamie Ellis' seller-death source packet

Send the death, spouse and deed clues before the file becomes an authority scramble.

For agents, lenders and attorneys: organize the death, marital-status, surviving-spouse, deed, lender and title-commitment clues so the right reviewer can answer the right question.

Audience and job

Make a deceased-seller file easier to route.

Seller-death closings can mix a deed history, death evidence, marital status, surviving-spouse facts, children from different relationships, probate clues, lender conditions, title requirements and attorney review. This handoff keeps the sources separated before the file turns into a closing-week debate about status or authority.

The useful handoff

Name the county, deed, deceased owner, surviving spouse, family-status clue, probate clue, lender condition and title-commitment question you have. The record, court file, attorney advice, lender, title commitment and underwriting review still control the file-specific result.

Official sources

Use current Family Code, Estates Code and county-record sources.

These sources were checked on September 28, 2026. They help frame the seller-death packet, but they do not replace court, deed, lender, title, underwriting, probate, family-law or legal review.

Texas Family Code Chapter 3, read September 28, 2026

Separate the marital-property clue from the conclusion.

Chapter 3 is the Texas source for separate property, community property and the presumption of community property. Send the marriage, deed, acquisition and record clues; do not decide whether a property interest is separate, community or subject to a spouse's management rights.

Texas Estates Code Chapter 201, read September 28, 2026

Flag intestacy and surviving-family facts early.

Chapter 201 is the Texas intestate-succession source, including community-estate provisions when a person dies without a will. Send the death, spouse, child, descendant and probate-status clues without deciding inheritance, heirship, homestead, title or sale authority.

Collin County Land Recordings, read September 28, 2026

Tie the question back to the recorded instruments.

Collin County's land-recording page warns that online database results are not the official repository and may not show the complete or unaltered official record. Send instrument numbers, recording dates, party names and source links without treating a search hit as the full title answer.

What to send

Give each reviewer the seller-death source they can verify.

A seller-death and community-property handoff does not need to decide marital-property status, surviving-spouse rights, inheritance, title coverage, lender approval or underwriting acceptance. It needs enough source context for the right professional to identify the next step.

  1. Property address, county, contract status, target closing date and whether the file involves a deceased seller, surviving spouse, current spouse, former spouse, children from this marriage, children from another relationship, probate clue, lender condition or title-commitment requirement
  2. Death certificate clue, obituary clue, will, probate filing, letters, affidavit of heirship, small-estate affidavit, marriage record clue, divorce decree, premarital-property clue, deed history, current deed or title commitment already available
  3. Names of the deceased owner, surviving spouse, proposed seller, current spouse, former spouse, children, heirs, executor, administrator, attorney, lender, payoff contact and any person whose status is unclear
  4. Instrument numbers, recording dates, book/page or document references, county, legal description, title-commitment item number, lender-condition clue and public-source URL already found
  5. One practical process question for the title team, lender, probate attorney, family-law attorney, estate-planning attorney, underwriter or county-record source before the file reaches funding or signing pressure
What to avoid

Keep death, spouse and title conclusions out of the first note.

  • Do not decide community-property status, separate-property status, homestead rights, surviving-spouse rights, heirship, intestacy, probate effect, signature authority or whether a spouse, heir, executor or administrator may convey.
  • Do not decide whether a death certificate, affidavit of heirship, small-estate affidavit, probate order, deed, divorce decree, will, release or title-commitment response is sufficient.
  • Do not draft affidavits, probate pleadings, deeds, releases, title objections, lender conditions, marital-property agreements, family settlements or attorney legal cures.
  • Do not promise lender approval, funding, title coverage, underwriting acceptance, county-record acceptance, probate timing or a closing date.
