Jamie Ellis' seller-disclosure source packet

Send the current form and source trail before the disclosure question crowds the closing.

For agents and sellers: collect the current TREC disclosure, property and contract context, repair or permit clues, lender condition, title-commitment item and one process question in one reviewable handoff.

Audience and job

Make a seller-disclosure question easier to route.

A seller-disclosure question can touch the current form, contract, repair history, permits, inspection, insurance, a lender condition, county records or the title commitment. This guide keeps the source trail together without deciding the transaction-specific answer.

The useful handoff

Name the form version, property and timing context, the section or topic to discuss, sources already available and the first process question. The seller, broker, lender, title team, underwriter, attorney and public agencies retain their own roles and decisions.

Official sources

Use the current TREC form and public-record context.

These sources were checked on October 15, 2026. They frame the packet, but do not replace seller, broker, lender, title, underwriting, attorney, insurance, inspector, contractor or county-record review.

Texas Real Estate Commission, checked October 15, 2026

Start with the current TREC disclosure form.

TREC lists Seller's Disclosure Notice Form 55-1 with an effective date of May 28, 2026. Its page says the form concerns information required by Property Code Section 5.008 for previously occupied single-family residences. Send the current form version and transaction context; do not decide whether a particular disclosure is required or sufficient.

Keep the statutory reference with the packet.

Texas Property Code Section 5.008 is the state source TREC identifies for the Seller's Disclosure Notice. A handoff can identify the property type, occupancy history, contract context and the question to route without interpreting the statute or choosing a seller's answer.

Collin County Clerk, checked October 15, 2026

Use recording clues as clues, not conclusions.

The Collin County Clerk says its online database is not the official repository and may not show complete or unaltered real-property records. Send a document number, complete instrument or record-request clue when a disclosure question overlaps a deed, release, notice or permit trail.

What to send

Give the right reviewer a source trail they can verify.

A disclosure handoff is not a legal conclusion, title decision, lender decision or repair opinion. It is a way to put the relevant form, timeline and source documents beside the first question before the file becomes urgent.

  1. Property address, county, property type, occupancy history if known, executed-contract date, proposed closing date, lender condition, title-commitment item and one question to route
  2. The completed or in-progress Seller's Disclosure Notice, form edition shown on the document, addenda or amendments, and a short note identifying which section or topic needs process guidance
  3. Source documents already in hand, such as repair invoices, insurance-claim correspondence, permits, inspection reports, warranties, contractor information, prior disclosures, photographs, deed or recording references
  4. A neutral timeline: when the seller learned information, when a repair or event occurred, when an update was discussed, and whether another party has asked for a document—without characterizing fault, compliance or legal effect
  5. One practical process question for the title team, broker, lender, attorney, underwriter, insurer, contractor, inspector or public-record source
What to avoid

Keep private data and legal conclusions out of the first note.

  • Do not decide whether a seller must disclose a fact, whether an answer is complete, whether a form or amendment is sufficient, or whether a party has a remedy, duty, claim or defense.
  • Do not decide materiality, knowledge, notice, defect status, code compliance, repair quality, permit compliance, insurance coverage, lender acceptance, fraud, liability or legal effect.
  • Do not place Social Security numbers, driver-license or passport numbers, insurance-policy numbers, bank or card data, wire instructions, account credentials, private inspection reports or privileged legal advice in the public form.
  • Do not promise title coverage, insurability, underwriting acceptance, lender approval, final settlement figures, funding, recording or a closing date.
