Jamie Ellis' survey and exception source packet

Send the survey, affidavit, plat and commitment trail before a boundary question slows the file.

For agents and lenders: collect the survey, T-47 or T-47.1 clue, contract survey paragraph, plat, legal description, county recording reference, commitment item and one process question before a survey exception becomes urgent.

Audience and job

Make a survey exception easier to route.

A survey question can pull in a contract deadline, old survey, T-47 affidavit, title commitment, Schedule B exception, lender condition, plat, legal description, fence, driveway, addition, easement, surveyor note, underwriter review and attorney advice. This handoff keeps the source trail together without deciding the file-specific result.

The useful handoff

Name the county, tract, survey date, preparer, affidavit, plat, commitment item, recorded instrument and source date. The contract, survey, title commitment, lender instruction, underwriting response, surveyor review and legal advice still control the answer.

Official sources

Use current TDI, TREC, statute and county-record sources.

These sources were checked on October 9, 2026. They help frame the survey exception packet, but they do not replace lender, survey, title, underwriting, attorney, recording or legal review.

TDI Procedural Rule P-2, read October 9, 2026

Start with the area-and-boundary exception source.

TDI P-2 addresses the survey exception, acceptable existing surveys, the T-47 affidavit for residential real property and the T-47.1 unsworn declaration option. Preserve the survey date, affiant, land description and title-commitment item without deciding coverage or boundary effect.

TDI Form T-47, read October 9, 2026

Keep the affidavit together with the survey it verifies.

The T-47 is a title-insurance form used to verify an existing residential survey. Send the signed affidavit, the complete survey, the survey date, property address and any visible change clue instead of summarizing the affidavit from memory.

TREC Form 20-19 page, read October 9, 2026

Treat the contract form as a source for the survey handoff.

TREC lists the One to Four Family Residential Contract (Resale), Form ID 20-19, with an effective date of 07/01/2026. When that contract is the source, preserve the survey paragraph, deadlines, notices and addenda without choosing a party's contract answer.

Texas Occupations Code Chapter 1071, read October 9, 2026

Route surveyor questions to survey professionals.

Chapter 1071 defines professional surveying and registered professional land surveyors. A title handoff can identify survey-source clues, but boundary location, easement depiction, field notes, metes and bounds and survey opinions belong with the surveyor or legal reviewer.

Collin County Land Recordings, read October 9, 2026

Anchor plats and survey clues to county-record references.

Collin County's land-recording page includes plat filing requirements and warns that the online database is not the official repository of real property records. Send instrument numbers, plat names, recording dates, parties, legal descriptions and complete pages.

TDI Procedural Rule P-53, read October 9, 2026

Keep the handoff public, educational and referral-safe.

TDI P-53 permits legal promotional and educational activity that is not conditioned on referral of title-insurance business. This handoff offers public source organization only; it does not discount a title premium or provide a referral benefit.

What to send

Give each reviewer the survey packet they can verify.

A survey exception handoff does not need to decide boundary location, access, encroachments, shortage in area, easement rights, title, insurability or legal effect. It needs enough source context for the right professional to identify the next step.

  1. Property address, county, transaction type, proposed closing date and whether the question involves a new survey, existing survey, T-47, T-47.1, plat, legal description, improvement, fence, driveway, pool, addition, easement, access, title-commitment Schedule B or C item or lender condition
  2. Complete survey or plat, the T-47 or other affidavit, contract survey paragraph, addenda, title commitment, exception item, lender condition, county recording reference and any marked page that raised the question
  3. Survey date, preparer or surveyor name, affiant name, buyer, seller, lender, property owner, easement holder, subdivision, lot, block, phase, tract label, document number and recording date
  4. Clear copies of the full survey or plat pages, including notes, legends, certifications, revision blocks, easement labels, legal descriptions, adjoining tract labels and any marked-up version from the agent, lender, seller, buyer, surveyor or attorney
  5. One practical process question for the title team, surveyor, lender, attorney, underwriter, county-record source or other reviewer before the file reaches funding or signing pressure
What to avoid

Keep boundary and survey conclusions out of the first note.

  • Do not decide whether a survey, T-47, T-47.1, plat, legal description, exception, easement depiction, improvement note, encroachment clue or title-commitment response is valid, sufficient, accurate, enforceable or legally effective.
  • Do not decide boundary location, access, encroachment, shortage in area, easement rights, fence ownership, setback compliance, improvement legality, surveyor negligence, title effect or recording effect.
  • Do not draft survey objections, title objections, legal descriptions, correction instruments, affidavits, easement terms, access agreements, lender responses or legal-remedy language.
  • Do not promise lender approval, title coverage, underwriting acceptance, survey acceptance, county-record acceptance, recording, insurability or a closing date.
