Jamie Ellis' tax-lien source packet

Send the lien, release and certificate trail before a tax question slows funding.

For agents, lenders, investors and attorneys: collect the IRS or Texas lien clue, release or certificate evidence, county recording reference, commitment item, lender condition and one process question before a tax-lien issue becomes urgent.

Audience and job

Make a tax-lien question easier to route.

A tax-lien issue can pull in IRS records, Texas Comptroller collection records, county land records, payoff evidence, releases, discharge or subordination certificates, lender conditions, title-commitment items, underwriter review and attorney or tax-professional advice. This handoff keeps the source trail together without deciding the result.

The useful handoff

Name the county, taxpayer or entity, lien source, instrument number, release or certificate clue, payoff status, lender condition, title-commitment item and source date. The recorded documents, tax professional, attorney, lender, title commitment and underwriting response still control the file-specific answer.

Official sources

Use current IRS, Comptroller, county-record and TDI sources.

These sources were checked on October 5, 2026. They help frame the tax-lien packet, but they do not replace tax, lender, title, underwriting, attorney, recording or legal review.

IRS federal tax lien guidance, page updated June 28, 2026; read October 5, 2026

Start with the IRS lien status and certificate lane.

The IRS explains federal tax liens, releases, discharge of specific property, subordination and withdrawal. A useful handoff preserves the notice, taxpayer name, property, recording reference, payoff or certificate clue and title-commitment item without deciding eligibility or legal effect.

Texas Comptroller past-due tax guidance, read October 5, 2026

Separate state tax lien clues from IRS clues.

The Texas Comptroller says past-due state tax collection actions can include tax liens in applicable counties, and that taxpayers should contact the Comptroller about past-due accounts. Send the taxpayer ID clue, entity name, notice, field-office contact clue, lien record and title item rather than treating every tax lien alike.

Collin County Clerk FAQ, read October 5, 2026

Use the county-record trail without doing a phone search.

Collin County says the clerk cannot do lien searches by phone, releases may be brought or mailed for recording, recorded documents show on public stations after a short posting window, and a document number can serve as a reference. Keep instrument numbers, names, dates and document numbers in the packet.

Collin County land-recording fee sheet, revised March 21, 2024; read October 5, 2026

Know when the item is a land-record filing clue.

The Collin County fee sheet lists state tax liens or releases among land-record instruments and separately lists a state tax lien or release filed by the state. That makes the recording reference, return address, filing party and copy request part of the practical handoff.

TDI Procedural Rule P-53, read October 5, 2026

Keep the handoff public, educational and referral-safe.

TDI P-53 permits legal promotional and educational activity that is not conditioned on referral of title-insurance business. This handoff offers public source organization only; it does not discount a title premium or provide a referral benefit.

What to send

Give each reviewer the lien and release trail they can verify.

A tax-lien handoff does not need to decide validity, attachment, priority, payoff sufficiency, release effect, discharge effect, subordination effect, withdrawal effect, insurability or legal effect. It needs enough source context for the right professional to identify the next step.

  1. Property address, county, current contract status, target closing date and whether the concern involves a federal tax lien, state tax lien, property-tax clue, release, certificate of discharge, subordination, withdrawal, payoff, title-commitment requirement or lender condition
  2. Taxpayer or entity name exactly as shown on the notice, public record, payoff, release, title commitment or lender condition; include alternate names, DBA names and entity-status clues only as source context
  3. County recording reference, instrument number, recording date, document number, release or certificate reference, title-commitment Schedule B or C item number and any underwriter or lender request that triggered the question
  4. IRS or Comptroller contact clue, payoff request status, payment or satisfaction evidence, certificate application status, release document, withdrawal request, discharge or subordination clue and the person responsible for follow-up
  5. One practical process question for the title team, lender, tax professional, attorney, underwriter or county-record source before the file reaches funding or signing pressure
What to avoid

Keep tax status and remedies out of the first note.

  • Do not decide whether a federal, state, property-tax or transferred-tax lien is valid, attached, collectible, released, discharged, subordinated, withdrawn, expired or legally effective.
  • Do not decide lien priority, payoff sufficiency, certificate sufficiency, redemption, tax liability, discharge eligibility, subordination eligibility, title effect or bankruptcy effect.
  • Do not draft tax, release, lien, court, payoff, settlement, discharge, subordination, withdrawal or legal-remedy language.
  • Do not promise lender approval, funding, title coverage, underwriting acceptance, recording, county indexing, insurability or a closing date.
