Jamie Ellis' TODD source packet

Send the TODD, death and beneficiary clues before the file becomes a status scramble.

For agents, lenders and attorneys: organize the recorded transfer-on-death deed, cancellation, affidavit of death, beneficiary, lender and title-commitment clues so the right reviewer can answer the right question.

Audience and job

Make a transfer-on-death deed file easier to route.

TODD-related closings can mix a recorded deed, a cancellation, an affidavit of death, beneficiary identity, survivorship facts, probate clues, lender conditions, title requirements and attorney review. This handoff keeps the sources separated before the file turns into a closing-week debate about status or authority.

The useful handoff

Name the county, instrument, deceased owner, beneficiary, cancellation or affidavit-of-death clue, lender condition and title-commitment question you have. The record, court file, attorney advice, lender, title commitment and underwriting review still control the file-specific result.

Official sources

Use current Estates Code, court-form and county-record sources.

These sources were checked on September 27, 2026. They help frame the TODD packet, but they do not replace court, deed, lender, title, underwriting, probate or legal review.

Texas Estates Code Chapter 114, read September 27, 2026

Start with the official TODD statute.

Chapter 114 is the Texas Real Property Transfer on Death Act source for transfer-on-death deeds, revocation, effect during life, effect at death and creditor-claim context. Send the deed, cancellation, death and beneficiary clues; do not decide whether the TODD works for the file.

Texas courts TODD form packet, read September 27, 2026

Keep the court-published form lane visible.

The Texas court forms packet includes transfer-on-death deed, cancellation and affidavit-of-death materials for Texas real property. It is useful source context for what the signer or beneficiary may have used, not a title-company or legal conclusion about a recorded instrument.

Collin County Land Recordings, read September 27, 2026

Tie each TODD clue to the county record.

Collin County's land-recording page warns that online database results are not the official repository and may not show the complete or unaltered official record. Send instrument numbers, recording dates, party names and the county-record source without treating a search hit as the full title answer.

What to send

Give each reviewer the TODD source they can verify.

A transfer-on-death deed handoff does not need to decide beneficiary rights, revocation, survivorship, title coverage, lender approval or underwriting acceptance. It needs enough source context for the right professional to identify the next step.

  1. Property address, county, contract status, target closing date and whether the file involves a sale, refinance, deceased owner, TODD beneficiary, cancellation, affidavit of death, probate clue, lender condition or title-commitment requirement
  2. Recorded transfer-on-death deed, cancellation of transfer-on-death deed, affidavit of death, death-certificate clue, divorce-decree clue, revocation clue, prior deed, current deed or title commitment already available
  3. Names of the deceased owner, surviving co-owner, TODD beneficiary, alternate beneficiary, proposed seller, signer, executor, administrator, attorney, lender, payoff contact and any person whose status is unclear
  4. Instrument numbers, recording dates, book/page or document references, county, legal description, title-commitment item number, lender-condition clue and public-source URL already found
  5. One practical process question for the title team, lender, probate attorney, estate-planning attorney, underwriter or county-record source before the file reaches funding or signing pressure
What to avoid

Keep TODD and title conclusions out of the first note.

  • Do not decide TODD validity, revocation, beneficiary rights, survivorship, divorce effect, creditor rights, homestead status, probate effect or whether a recorded affidavit of death is sufficient.
  • Do not decide whether a beneficiary, alternate beneficiary, surviving co-owner, executor, administrator, heir or attorney may sell, refinance, sign, convey or bind a transaction.
  • Do not draft transfer-on-death deeds, cancellations, affidavits of death, probate pleadings, deeds, releases, title objections, lender conditions or attorney legal cures.
  • Do not promise lender approval, funding, title coverage, underwriting acceptance, county-record acceptance, probate timing or a closing date.
