Jamie Ellis' trust-owned property source packet

Send the trust, trustee and deed clues before the file becomes an authority debate.

For agents, lenders, sellers, buyers, investors and attorneys: organize the trust certificate, trustee names, deed records, lender conditions and commitment items so the right reviewer can answer the right question.

Audience and job

Make a trust-owned property file easier to route.

A trust-owned sale or refinance can raise several questions at once: who the trustee is, whether a successor trustee is acting, what document names the authority source, what the deed says, what the lender requires and whether counsel needs to answer a trust or probate question. This handoff keeps those sources separated before the file turns into a signature argument.

The useful handoff

Name the trust, trustee, deed, lender or title-commitment source you have and ask one process question. The trust instrument, certificate, deed records, lender instructions, title commitment, attorney advice and underwriting review still control the file-specific result.

Official sources

Use current trust, land-record and TDI sources.

These sources were checked on September 20, 2026. They help frame the trust-property packet, but they do not replace trust, deed, lender, title, underwriting, probate or legal review.

Texas Property Code Section 114.086, read September 20, 2026

Use the Certification of Trust as a source clue.

Section 114.086 is the Texas source for a certification of trust. Send the certificate, relevant trust excerpts if counsel provides them, trustee names, co-trustee signature details and the title-commitment item instead of guessing whether the trust document is enough.

Texas Property Code Chapter 113, read September 20, 2026

Route trustee power questions to the right reviewer.

Chapter 113 includes trustee-power provisions, including language about a trustee's ability to contract to sell, sell and convey, or grant an option involving trust property. A handoff should identify the source documents and the transaction step; it should not decide trustee authority.

Collin County Land Recordings, read September 20, 2026

Keep deed-record clues separate from authority review.

Collin County's land-recording page warns that its online database is not the official repository and may not show the complete or unaltered official record. Send instrument numbers, recording dates, grantor and grantee names, county, and the land-record source without treating an online hit as the whole title answer.

TDI Procedural Rule P-53, read September 20, 2026

Make the guide public, neutral and referral-safe.

TDI P-53 permits legal promotional and educational activity that is not conditioned on referral of title-insurance business. This handoff offers source organization only; it does not discount a title premium or provide a referral benefit.

What to send

Give each reviewer the trust-property fact they can verify.

A trust authority handoff does not need to decide trustee authority, trust validity, probate effect, signature sufficiency, lender approval or underwriting acceptance. It needs enough source context for the right professional to identify the next step.

  1. Property address, county, transaction type, contract status, target closing date and whether the file involves a sale, refinance, cash-out, trustee change, successor trustee, deceased settlor, probate clue or lender condition
  2. Certification of trust, trust excerpt or attorney-provided authority packet already available, plus the trustee names and whether one or multiple trustees are expected to sign
  3. Recorded deed into or out of the trust, prior title policy or commitment, current title-commitment requirement or Schedule C item, and any instrument number already found
  4. Lender instruction, payoff contact, estate or probate contact, attorney contact, trust company contact or underwriter question already surfaced
  5. One process question for the title team, lender, attorney, underwriter or county-record source before the file reaches funding or signing pressure
What to avoid

Keep legal conclusions out of the first note.

  • Do not decide whether the trust is valid, revoked, amended, funded, terminated or interpreted correctly.
  • Do not decide trustee authority, successor-trustee status, co-trustee signature sufficiency or whether a certificate of trust is enough.
  • Do not draft trust amendments, trustee certificates, deeds, releases, affidavits, probate pleadings or lender instructions.
  • Do not promise lender approval, funding, title coverage, underwriting acceptance, curative timing, recording acceptance or a closing date.
